Acceptance of Terms

By using our website and enrolling in our services, you agree to be legally bound by these Terms and Conditions, as well as any other relevant policies or procedures. If you do not agree, please refrain from using our website or services.


Eligibility

Our early education and care services are available to families seeking care for children aged 6 weeks to 5 years. By enrolling a child, you confirm that you are the legal parent or guardian and have the authority to make decisions on behalf of the child.


Enrolment and Fees

Enrolment: Parents and guardians must complete all required enrolment documentation accurately, including information on the child’s medical, developmental, and care needs.
Fees: Fees for our programs (full-time, part-time, or casual care) are payable in advance, typically fortnightly or monthly, via direct debit or another approved method.
Late Fees: Overdue payments may incur late fees. Continued non-payment (30+ days) may lead to a temporary suspension of your child’s place until fees are settled.


Cancellations and Refunds

Notice of Cancellation: If you choose to withdraw your child, at least 2 weeks' written notice is required. This allows us to finalise billing and offer the place to another family.
Refunds: Refunds are generally not offered for days missed due to illness, holidays, or public holidays. Special circumstances may be reviewed at the discretion of the Centre Director.


Our Commitment to Care

Open Arms Early Education is committed to providing a safe, inclusive, and nurturing environment for all children. We reserve the right to discontinue care if a situation arises that affects the safety, wellbeing, or rights of other children, families, or educators.


Health and Safety

Health Information: All families must provide complete and current health details about their child, including immunisation records, allergies, and medical conditions, in accordance with NSW Health and National Quality Framework (NQF) requirements.
Illness Policy: Children who show signs of illness, such as fever, vomiting, or contagious infections, must be kept home. Open Arms reserves the right to request early collection or refuse attendance if a child is unwell to protect the wellbeing of all children and staff.


Your Rights and Responsibilities

We strive to uphold the highest standards of safety and care. While every reasonable precaution is taken, Open Arms Early Education is not liable for any injury or accident unless caused by demonstrable negligence or misconduct. Parents agree to work in partnership with educators and comply with centre policies to support a positive environment.


Privacy

We are committed to protecting your family’s privacy. Any personal information collected is stored securely and used only for enrolment and operational purposes in accordance with the Australian Privacy Principles (APPs). We do not share your data with third parties except where required by law or regulation (e.g., government reporting).


Updates to Terms

Open Arms Early Education reserves the right to update these Terms and Conditions at any time. Any changes will be made available on our website, and your continued use of our services implies acceptance of the updated terms.


Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising will be managed in accordance with NSW legal processes and jurisdictions.
